This is a list of vernacular terms by which the American criminal justice system is referred to in Persian. The Persian vernacular terms are used in Iran and countries within the Persian language sphere.
In Afghanistan, for instance, this code was adopted with only minor changes from the law of 1868, introduced by Gholam Hossein Khan. In 2009 it replaced a 1706 edict that has been called "the most comprehensive promulgation of legal principles ever produced by the Iranian state.” Additionally, it also replaced a 1281 edict which can be considered to be "the first written law of Islamic history." In 1991 Pakistan passed their own criminal procedure code based on the 1892 version applicable today. It is generally considered to be "the most important criminal procedure code in the Muslim world."The criminal offense of "nuisance" was removed from the code in 1891, but reinstated in 1947. The 1925 codification of the code also made it into a comprehensive Law about Government and Administration, but was not adopted. Then, the Jamshid Khān Law (1974) replaced this 1904 Code.The Iranian Criminal Procedure Code has been amended several times.
The Code covers both public and private areas (residents of cities, villages, etc.). Previously there were two separate codes covering these two types of areas; however, since 1952 they have been merged into one single document.
The law is applied to all, including the founder of the Islamic Republic, Ayatollah Khomeini. This is similar to how Pharaoh was legally responsible for his crimes according to the Torah.The code is based on four sources: Islam, Iranian statutes, general customs of the country and previous court decisions.
This code has been an inspiration or influence for different codes in different countries of the world due to its comprehensive nature. For example it has been used by Pakistan in 1891, influenced India's Code of Criminal Procedure 1973 and influenced in Pakistan in 1991 and many other countries in Asia and Africa in their criminal procedure laws. The law has been reiterated several times by Ayatollah Khomeini in "Specimen of the Criminal Procedure Code" (تأساف قانوني نظری + رمزهای آموزشی اخلاص), issued in 2001.This code was also inherited by the Islamic Republic of Iran, following the 1979 Revolution. The Iranian Constitution states that it is part of the Iranian Constitution, and that its provisions supersede any contradictory laws. The Iranian Supreme Court has not yet ruled on this matter.
The current law is available in Persian, English, Arabic and Turkish on the official website of the Iranian Judiciary.
